After California Secretary of State Shirley Weber tried disqualifying Larry Elder on a technicality on entering the governor recall election, a federal judge struck down the charges in question and reinstated him.
Per Politico, the decision that came down from a judge is that Larry Elder is reinstated and allowed to run in the California recall race, and that the state elections chief had no authority to demand five years of tax returns.
Sacramento Superior Court Judge Laurie Earl interpreted the law as this being a special election and not a standard “direct primary.”
“I won my court case, I will be included on the ballot to recall this Governor Gavin Newsom. The recall election takes place on September the 14th. I want to thank Judge Earl for being fair, which he ruled was that this election law didn’t even apply to recall elections, and even if it did, I substantially complied.”
According to Fox News the timeline of this is very rapid. It was only on July 12th that Larry Elder had announced throwing his hat into the ring against California’s Governor Gavin Newsom in the recall election.
But on July 18th (this past Sunday), the Elder campaign office was told that Larry could not qualify for the ballot.
It required a lawsuit because the California Secretary of State refused to put Elder on as a candidate over “allegedly incorrect redactions,” by that meaning on his tax returns.
The so-called law the state of California put into play was requiring submitting the past five years of tax returns. Something that was passed through in recent years in response to the fuss over former President Trump’s reluctance to publish his own tax returns.
Allegedly, the letter from the Secretary of State’s office didn’t make it clear what Elder did wrong. Larry stood by his commitment to due diligence and that even if there was an error, the appropriate punishment wouldn’t be disqualifying him from the race.

His remarks on the lawsuit outcome are: “I want to express my deepest gratitude to the Superior Court of California, our friends, volunteers, supporters, and the people of California. We fought the shenanigans of Sacramento’s politicians and we won. If elected governor, I will fight every single day for this state. This is just the beginning.”
