Buffalo Police to Confiscate Guns from Families of Dead Relatives

I’ve often told people that it pays to find out what laws are still on the books in your city, county and state. You never know when some liberal will find an archaic law that has not been enforced for years and suddenly take it upon themselves to start enforcing it, generally at the cost to law abiding citizens.

In the state of New York, which already has some of the strictest gun laws in the nation, there is a little known law that has rarely been enforced that says that the family of a permitted gun owner who dies has 15 days to dispose of all firearms or turn them over to the police. If caught violating the law, which is a misdemeanor, the survivors in possession of the guns could face up to a year in jail and fines.

Daniel Derrenda, Buffalo Police Commissioner has just announced that his department is going to start enforcing this law and confiscating the guns that once belonged to legal permit holders who have died. His department is going to start cross referencing permit holders with death records and then send his officers out to confiscate the guns. He stated that when people die, family members often forget about the guns and if someone breaks in they could steal them and the guns could end up in the wrong hands. He was quoted as saying:

“At times they lay out there and the family is not aware of them and they end up just out on the street.”

Isn’t the same thing possible if someone breaks into the home of a living legal gun owner? Derrenda’s logic doesn’t really make sense. It sounds more like an excuse to confiscate guns from law abiding citizens, just like former New York City Mayor Michael Bloomberg has been advocating for several years.

Tom King, President of the New York State Rifle & Pistol Association warns citizens to know the law before surrendering all of their guns. He said:

“They’re quick to say they’re going to take the guns, but they don’t tell you the law doesn’t apply to long guns, or that these families can sell [their loved one’s] pistol or apply to keep it.”

The pro-Second Amendment website BearingArms.com posted:

“What the Buffalo PD is hoping to accomplish is blindingly obvious. They’re going to use the relative’s pistol permit as the proverbial camel’s nose under the tent to get at every firearm they can, hoping to remove all the firearms from the home while the family is at their most vulnerable.”

“While a family is still reeling from the loss of a beloved mother, father, brother, son, or sister, uniformed officers from the Buffalo Police Department are going to show up at their doors and attempt to bully the family into surrendering their recently deceased relative’s firearms… all of them, if they can.”

“The handgun on the pistol permit is an excuse, but the officers will obviously try to convince the grieving family that they should surrender all of the other firearms belonging to the decedent as well.”

“The Buffalo PD try to get family’s to turn over what may very well be heirlooms, without allowing the family to pass them along to other family members who might appreciate them.”

“This is a despicable and heartless practice, and should be ended immediately.”

I recall that when the New York legislature passed their strict gun control laws and Gov. Cuomo signed them into law, then Texas State Attorney General Greg Abbott took out ads in several New York areas inviting gun owners to move to Texas. About now would be a good time for Abbott, the newly elected Gov. of Texas, to run a few of those ads in the Buffalo area.

Liberal Democrats are trying to do everything they can to disarm law abiding Americans. They say it is only to help fight gun violence, but for the most part, law abiding citizens are not the ones committing the violence. These liberals care nothing about the constitutional right to protect one’s self, family and home nor do they care about the Second Amendment right to own and bear arms.

They would prefer that you not have a loaded gun handy when someone breaks into your house. Instead, they want you to rely on being able to call the police and pray that the police respond in time to save your life or the lives of your loved ones. As for your possessions, they could care less if they’re stolen and sold for drug money.

To be honest, with the horrible winter snow storms and weather in the Buffalo area and now how they are trying to confiscate guns from dead people’s families at the time the families are grieving, why would anyone want to live in such a miserable place? If you live in the Buffalo area or anywhere in the state of New York and you value your constitutional and Second Amendment rights, all I can say to you is get the heck out of Dodge and move to a state that also values your rights and freedoms.
