Del Bigtree says “the mandate of a mask is unenforceable by police, but the mandate by a private company is enforceable because the police are coming to arrest you for trespassing, for not adhering to the rules of that private company, whether it’s an airport or a restaurant or a grocery store that wants to force you to wear a mask.”Tony Roman, the owner of Basilico’s Restaurant in Huntington Beach, not only decided to never shut down, but doesn’t allow people with masks to enter the premises. He has received death threats and threats to infect his restaurant. Roman says there is a criminal action against his restaurant, and he responded by directly challenging Governor Gavin Newsom to officially file charges so that he may present his case in front of a jury of his peers. The state’s liquor licensing board at an administrative hearing, but has not made a ruling, and instead has continued the case to another date, as yet unspecified. The restaurant remains open and serves a bustling crowd.
