New York Daily News reports:

 “Real Housewives of New Jersey” star Joe Giudice is in deportation proceedings as he remains in federal prison on a 41-month sentence.

A spokesman for the U.S. Immigration and Customs Enforcement (ICE) confirmed to the Daily News that it has lodged a detainer and Giudice is in removal proceedings from the United States back to his native Italy.

Giuseppe “Joe” Giudice Opens a New Window. , a native of Italy, is “in deportation proceedings while he’s in custody,” the ICE spokesperson told Radar. “ICE has lodged a detainer, and he is in removal proceedings.”

Though he isn’t scheduled for release until March 2019, Joe could be kicked out of the country before he’s completed his sentence.

“If he is ordered deported while in custody, he will be removed from the U.S.,” the spokesperson continued.

If he is able to complete his sentence, he will immediately be transferred to the care of ICE instead of returning home to Teresa and their four daughters.

The 46-year-old dad, who is more than two years into his more than three-year sentence Opens a New Window. , most recently attended a hearing via Virtual Teleconference on June 20 regarding his imminent deportation.

As Radar extensively reported, Joe is serving 41 months in prison on fraud charges Opens a New Window. . He recently transferred to Allenwood prison in Pennsylvania, where immigration issues are frequently handled.

Though it was always a possibility, the deportation is a recent development for Joe. In a September 2017 court filing, he admitted he was under an ICE detainer, but insisted he was not in removal proceedings.

According to NY Daily Mail, Joe Giudice “was transferred in November from the Federal Correctional Institution at Fort Dix, N.J., to a prison in Allenwood, Pa. The move came because Giudice requested placement in a residential drug and alcohol abuse program, something Fort Dix denied him because an ICE detainer had been put in place.”
