It was one of the most viral moments in the summer. Mr. and Mrs. McCloskey standing on their property, armed, while a mob of unruly protesters that had destroyed a gate to trespass on their private street threatened their lives and home.

Nobody in that mob faced charges. But the couple feared for their lives, and had to hire some retired Navy Seals to organize the security of their home when locals were preparing to descend on their home again. We were disappointed, but not surprised to see that the mob wasn’t facing any charges. But when we saw that the McCloskeys faced charges for defending themselves from a threat when the police weren’t coming, we were pissed.

The Governor had pledged to give a pardon if there was a conviction, but charges should never have been brought in the first place.

The judge in the case might agree, at least in part.

The circuit attorney for the city of St. Louis has been disqualified from prosecuting Mark and Patricia McCloskey, a local couple facing felony charges after defending their home with weapons when protesters marched through their neighborhood in June, according to reports.

The content of some campaign fundraising emails by Circuit Attorney Kim Gardner infringed on the McCloskeys’ right to receive a fair trial, Circuit Judge Thomas Clark II ruled Thursday, according to the St. Louis Post Dispatch.

Gardner’s emails suggested that by charging the McCloskeys in July, she appeared to have “initiated a criminal prosecution for political purposes,” the judge wrote, according to the newspaper.

“Like a needle pulling thread, she links the defendant and his conduct to her critics,” Clark wrote. “These emails are tailored to use the June 28 incident to solicit money by positioning her against defendant and her more vocal critics.” –FoxNews

This isn’t even addressing the OTHER issue about evidence tampering with respect to McCloskey’s pistol.
